NOTICE OF PUBLIC HEARING

PUBLIC NOTICE is hereby given to all persons concerned that on the 18st day of July, 2018, at 7:00 p.m., in the City Council Chambers of the Municipal Building, at 100 North Island Avenue, Batavia, Illinois, the Plan Commission of the City of Batavia will meet and a Public Hearing will be held pursuant to Chapters 3.1, 5.2, 5.3, 5.7, and 5.8 of the Batavia Zoning Code (City Code Title 10) to consider amending the Comprehensive Plan Land Use Map and the Official Zoning Map with a Planned Development Overlay District and Arterial Setback Overlay District. At the same time, the Plan Commission will hold an open meeting to consider Design Review and preliminary and final plat of subdivision of property. All actions are for property proposed to be annexed to the City of Batavia located at 37W407 Fabyan Parkway (PIN 12-17-200-014), 37W475 Fabyan Parkway (12-17-200-006), and 2401 Hawks Drive (12-17-200-032), together with the adjacent Fabyan Parkway and Janet Lane rights-of-way.

The property is legally described as:

LOT 1 OF OWNER’S RESUBDIVISION OF LOTS 1 AND 4, MEADOW CREST ESTATES, GENEVA TOWNSHIP, KANE COUNTY, ILLINOIS, IN THE TOWNSHIP OF GENEVA, KANE COUNTY, ILLINOIS; and

The applicant for all actions is MR JNB BATAVIA, LLC, c/o Russell Construction Co., Inc, 4600 E. 53rd St., Davenport, IA 52807. The applicant proposes to amend the Comprehensive Plan Land Use Map for the subject properties from General Commercial to Mixed Use and to amend the Zoning Map for the subject properties from R0 Single Family Residential (after annexation) to MU Mixed Use District with a Planned Development Overlay District with modifications to the Zoning Code and Arterial Setback Overlay District. The Planned Development Overlay District and Design Review propose a Congregate Living Facility with associated improvements. The subdivision proposes variations to the Subdivision Regulations, consolidation of the property into a single lot, and vacation of the Janet Lane right-of-way.
