NOTICE OF HEARING - CITY OF BATAVIA
SPECIAL SERVICE AREA NUMBER 66

NOTICE is given that on the 21st day of September, 2020 at 7:35 p.m. in the City Council Chambers of the Batavia City Hall, 100 North Island Avenue, Batavia, Illinois, a Public Hearing will be held by the City Council to consider the establishment of a Special Service Area (SSA 66) consisting of certain portions of the City of Batavia, Kane County, Illinois.
The area is located in the northwest quadrant of the City, generally east of Randall Road and south of Mill Street, and mostly north of McKee Street.

The property is legally described as follows:  LOTS 2 AND 4 OF KINGSLAND SUBDIVISION UNIT 2 RECORDED ON MARCH 13, 1993 AS DOCUMENT 93K17184, IN THE CITY OF BATAVIA, KANE COUNTY, ILLINOIS (PINS 12-16-351-016 AND 12-16-351-003); AND 

LOTS 2, 4 AND 6 OF BATAVIA LAND COMPANY SUBDIVISION NO. 1, IN THE CITY OF BATAVIA, KANE COUNTY ILLINOIS RECORDED AS DOCUMENT 95K040212 (PINs 12-16-351-008, 12-16-351-010 AND 12-16-351-012); AND

All interested parties will be given an opportunity to be heard regarding the formation of, and the boundaries of, proposed SSA 66 and may object to the formation of the area and the levy of taxes affecting the area.
The purpose of the formation of the SSA 66 in general is to provide special municipal services to the area including but not limited to maintenance of Stormwater Management Facilities and their appurtenances, and other common area improvements such as landscaping.  Such actions are only as a back-up in the event that the Owners or Owners Association, as the case may be, dissolves or otherwise fails to maintain said improvements.
There will be considered at the public hearing a special tax to be levied only if necessary, against the real property included within the special service area. The tax will be levied only in the event the Owners or Owners Association, as the case may be, dissolves or otherwise fails to maintain said improvements.

The special tax levied shall not exceed a rate of fifty cents ($0.50) per $100 of assessed valuation, as equalized, of the real property included in the Special Service Area.  The initial proposed levy shall be an annual rate of zero dollars ($0.00) per $100 of assessed valuation, as equalized, of the property in the Special Service Area.

At the hearing, all persons will be given an opportunity to be heard. The hearing may be adjourned by the City Council to another date without further notice other than a motion to be entered upon the minutes affixing the date and place of its adjournment.
If a petition signed by at least 51% of the electors (registered voters) residing within the proposed Special Service Area Number 66 and a petition by at least 51% of the owners of record of the land included within the boundaries of the proposed Special Service Area Number 66 are filed with the City Clerk no later than sixty (60) days following the final adjournment of the Public Hearing, which petitions object to the formation of the SSA, the levy or imposition of a tax or the provision of the special services to the area, no such district may be created or tax may be imposed.
