NOTICE OF PUBLIC HEARING
PUBLIC NOTICE is hereby given to all persons concerned that on the 18th day of May, 2022, at 7:00 p.m., the Plan Commission of the City of Batavia will meet and a Public Hearing will be held pursuant to Chapters 3.1, 5.2, 5.4, and 5.8 of the Batavia Zoning Code to consider Amendments to the Official Zoning Map for a Planned Development Overlay District. The Plan Commission concurrently will hold an open meeting to consider Design Review, pursuant to Zoning Code Chapter 5.6.
The property that is subject of the hearing is located at 1980 McKee Street (Lot A of Avenue Marketplace Subdivision, PIN 12-21-108-007). The applicant is Christopher Enright, NCARB of Enright Architects 628 E Parent Ave. Suite 100 Royal Oak MI 48067 and the property owner is Avenue Marketplace LLC PO BOX 221 North Aurora, IL 60542-0221.
The applicant proposes to modify the Planned Development Overlay granted by Ordinance 19-15 and amended by Ordinance 21-45 to request certain modifications from the Zoning Code. These modification requests include modification to Table 2.304 to allow an interior side building setbacks (north) of 15 feet rather than the 20 feet required and the minimum required perimeter landscape area of 15 feet (north) and 10 feet (south instead of the required 20 feet. A modification from 4.207 to allow a driveway of approximately 53.1 feet rather than the 40 feet’ required. A modification from the Sign Regulation 4.402.J to permit a 45 foot flagpole rather than the 35 foot allowed by the Zoning Code and other modifications that may be required for the proposed plan. The Planned Development Amendment and Design Review is for a proposed Belle Tire retail store.
Pursuant to Governor Pritzker’s Executive Orders in effect when publication of this legal notice was requested, the Plan Commission meeting at which this advertised Public Hearing is to occur may be conducted solely virtually via electronic means. The meeting’s agenda will be posted a minimum of 72 hours before the meeting at: www.cityofbatavia.net/agendacenter and the posted agenda will provide instruction on how one may attend and participate in the virtual meeting and public hearing. Go to www.cityofbatavia.net/PC2 to register for the Zoom meeting. Should the Executive Order that authorizes virtual meetings be lifted; the meeting shall be held at City Hall 100 North Island Avenue, Batavia IL 60510. Individuals that have registered for the virtual meeting will be notified by email prior to the Hearing of the change in venue. Public comments may also be e-mailed to firstname.lastname@example.org prior to the meeting for entry into the hearing public record.
