NOTICE OF PUBLIC HEARING
PUBLIC NOTICE is hereby given to all persons concerned that on the 14th day of February, 2023, at 7:00 p.m., in the City Council Chambers of the Batavia Municipal Building, 100 North Island Avenue, Batavia IL 60510, the City Council shall meet as the Committee of the Whole of the City of Batavia and a Public Hearing will be held pursuant to Chapters 5.2, and 5.4 of the City Zoning Code to consider the revocation of a Conditional Use Permit granted by Ordinance 16-67 for a Heavy Vehicle Services at 2080 Main Street, a property described legally described as:
LOTS 10, 12 AND 13 OF RESUBDIVISION OF PART OF UNIT NO. 2, WINDMILL LAKES, BATAVIA, KANE COUNTY, ILLINOIS, A RESUBDIVISION OF PART OF LOT 10, AND LOTS 11, 12 AND 13 OF UNIT NO. 2, WINDMILL LAKES, KANE COUNTY, ILLINOIS, ACCORDING TO THE PLAT THEREOF RECORDED OCTOBER 13, 1993 AS DOCUMENT 93K79562, IN KANE COUNTY, ILLINOIS. PIN 12-20-401-020, 12-20-401-023, AND 12-20-401-026;
The application is being initiated by the Planning & Zoning Officer of the City, pursuant to Section 5.404.C of the Zoning Code (Title 10 of the City Code) due to repeated violations of the conditions of Ordinance 16-67. Specifically condition 7 of which requires the storage of vehicles awaiting repair or completion of repair be stored in the building or within the provided fenced enclosure.

The meeting’s agenda will be posted a minimum of 72 hours before the meeting at: www.cityofbatavia.net/agendacenter and the posted agenda will provide instruction on how one may attend and participate in the meeting by electronic means. Public comments may also be e-mailed to drackow@cityofbatavia.net prior to the meeting for entry into the hearing public record.
