Dave's Hot Chicken 125 S Randall Rd- Conditional Use & Planned Development

PUBLIC NOTICE is hereby given to all persons concerned that on the 15th day of February, 2022, at 7:00 p.m., the Plan Commission of the City of Batavia will meet and a Public Hearing will be held pursuant to Chapters 3.1, 5.2, 5.4, and 5.8 of the Batavia Zoning Code to consider Amendments to the Official Zoning Map for a Planned Development Overlay District, and a Conditional Use Permit for a drive-through restaurant facility. The Plan Commission concurrently will hold an open meeting to consider Design Review, pursuant to Zoning Code Chapter 5.6 and Plat of Subdivision pursuant to Title 11 of the Municipal Code. 


The property that is subject of the hearing is located at 119 and 125 South Randall Road. The applicant is Raj Patel and the property owner of record is WINDMILL PLACE STATION LLC, Phillips Edison & Company, 11501 Northlake Dr, Cincinnati, OH, 45249, PIN 12-20-275-003. The applicant is seeking to construct a standalone building with a drive thru that is intended to be a Dave’s Hot Chicken Restaurant in a newly proposed out lot identified as 125 S Randall Road.


The applicant proposes to amend the Official Zoning Map to add a Planned Development Overlay to the existing zoning district classification of GC, General Commercial District with Arterial Setback Overlay District to both properties. The Applicant requests modifications from the zoning code under the Planned Development. The modification request include modification to Table 2.304 to allow a minimum landscaping area less than the required 15% . A modification from 3.203.A to allow the installation of a trash enclosure within 50 feet of a Strategic Regional Arterial right of way. The Planned Development, Plat of Subdivision, Conditional Use and Design Review is for the proposed Dave’s Hot Chicken restaurant site.
